The Jones Act
The Jones Act is a federal statute that allows seamen and maritime workers to seek compensation for injuries suffered on the job. To qualify as a seaman you must:
- Work "more or less permanently" on the sea (fishing boat, barge, cruise ship, vessel, offshore oil drilling rig)
- Be assigned to a vessel or fleet of vessels
- In navigation at the time of your accident
The term "more or less permanently" is generally interpreted to mean that the seaman had to have spent at least thirty percent of his or her time on a vessel at the time the injury occurred.
Cases involving the Jones Act are unique and require an attorney with maritime law experience. If you have been injured at work and qualify for the Jones Act, our maritime law attorneys can help you. We will work to ensure that you receive compensation for medical care, doctor bills, hospital bills and prescriptions.
The Longshore Act
The Longshore and Harbor Workers Compensation Act, or Longshore Act as it is more commonly called, provides protection to workers employed in common maritime work such as longshore operations, harbor work, ship construction and repair and loading and unloading of ships and vessels.
The Longshore act essentially fills the gap between the protections of the Jones Act and standard workers compensation benefits. If you have been injured on the job, a qualified maritime lawyer can help you determine whether or not you qualify for protection under the Longshore Act.
